Corporate Services Policy & Agreement
When partnering with KAE as your in-house service provider, each party agrees to the following.
Annual Service Minimum
To retain us as your in-house provider each year, we require a minimum spend of $450 per month, per location serviced. This solidifies our working relationship and allows us to add (and keep) you live in our system.
Proof of Purchase
Client/Purchaser will receive an email confirmation of their order once a purchase has been completed online via our website at www.kae-corporate.com. This is considered proof of purchase for all services.
Billing & Late Fees
All invoices/orders must be paid in full before we deliver anything or service your account. Custom invoices must be paid within 7 x days. Late fees of $50 per day will accrue on any overdue invoices, and all services will be discontinued until the billing issue has been resolved.
Plant Care & Conditioning
Your plants require at least 1 x water visit per week. Please ensure that our team will have access to your building and each floor on the days that we come by to refresh your account. We will also check each plant for pests, fungus, root rot, etc. at each visit and will treat each plant accordingly. We will also change out and amend the soil each year. If you would like to add additional plants, including faux plants, please let us know. These will be added to your profile and you will be billed accordingly.
Weekly Flower Deliveries
Your flowers come in our signature design style and will rotate each week. Please water them daily. We will also come by to refresh them on your set days. Once the arrangement has expired, please set it in the back for us to retrieve on our next swap.
Partnership Hotels/Venues
In-house plant care, conditioning, and floral design is provided and required through use of our service. As a corporate account, you will receive complimentary access to Trello. We provide this tool to help communicate and organize all events, weekly orders, and plans between our management contacts and yours. You will receive an email invite to join once your annual deposit has been paid. We will communicate directly through this tool for all of your locations' needs.
Provided Services
KAE is only responsible for providing the services that the Client/Purchaser has purchased online via our website www.kae-corporte.com. If additional services are needed, these may be purchased separately and will be added to our client database (Trello) for your location/s.
Ongoing Performance
KAE agrees to perform all purchased services made online via www.kae-corporate.com on time in connection with each of the Client/Purchasers locations. KAE maintains a zero-cancellation policy regarding KAE's ability to perform services for all orders and will strive to perform all services purchased to the furthest and most reasonable extent possible. Unless an unforeseen Force Majeure, Act of God, Catastrophic Circumstance, Extreme Weather, Global Pandemics or End of Life scenario occurs, we will be at your location to perform all services purchased.
Photo Release & Use
Client/Purchasers agree that KAE has the right to request, receive, and use any photos taken of the locations' events along with any purchased services for marketing and distribution purposes.
Client/Purchaser Responsibilities
The Client/Purchaser understands and agrees that KAE requires a measure of frequent communication with each Client/Purchaser regarding any orders placed. Failure to communicate with KAE regarding services or orders placed in a timely manner will result in an automatic non-refundable order cancellation after 30 Days' time.
Non-Liable Entity
KAE is never responsible for any other aspect of the Clients/Purchasers location or promised services other than what has been purchased through our website. Failure to meet 3rd party client/guest expectations due to circumstances outside of our purchased services is the responsibility of the Client/Purchaser or other service providers. This includes but is not limited to: Safety of the Location, Success of the Events, Practicality of the Events, Insufficient Planning on the Part of the Client/Purchaser, 3rd Party Clients or Guests, or other aspects of the event, provided services or location that may negatively impact the overall experience.
Changes in Pricing & Service/Agreement Updates
Occasionally new items are added to our website and services/agreements are revised. Clients/Purchasers receive the level of services/agreement and pricing that is listed at the time of purchase.
Legal Involvement
Clients/Purchasers agree to never pursue legal action against KAE regarding purchases or services made online via our website or as a result of services performed at the event. Clients/Purchasers understand that KAE does not enter into legal pursuits for any reason and that all legal fees associated with pursuing KAE are the financial responsibility of the Clients/Purchasers.
Limitation of Liability, Indemnification
Clients understand and agree that KAE shall not be held liable for any personal claims such as (but not limited to) emotional distress, mental anguish, consequential damages, punitive damages, lost profit, loss of enjoyment, lost revenues and/or replacement costs, whether or not foreseeable and/or arising from any negligent act or omission on the part of any person.
Clients understand and agree that KAE is not responsible for any product defects or imperfect resources, or supplies purchased at the request of the Clients that may negatively impact or affect the Event/s, and Clients waive any right to pursue any claim or cause of action against KAE for such.
Clients agree to indemnify, defend and hold harmless KAE and its employees, agents, independent contractors, officers, directors, members and/or managers for any injury, property damage, liability, claim or other cause of action arising out of or related to the acts or omissions of Clients and/or Clients’ Event guests, as well as any injury, property damage, liability, claim or other cause of action arising out of or related to the use of candles, open flame, water-filled containers, hanging décor and similar items.
KAE agrees to indemnify, defend and hold harmless Clients for any injury, property damage, liability claim, or other cause of action arising out of or related to the acts or omissions of KAE or its employees, agents, independent contractors, officers, directors, members and/or managers.
Clients acknowledge and agree that these requirements reflect a fair allocation of risk and that KAE would not enter into this Agreement without these limitations on its liability and indemnification requirements.
By purchasing services, you have automatically agreed to adhere to all aspects of this Agreement.
Cancellations & Refunds
We do not allow for refunds on any purchases made. All sales are final. If you need to cancel your account or our services, please notify us via Trello so that we can update your account.
